It should be legal to sell as it's a 'best before' date not a 'use by'. Andy, there's no such thing as 'sell by' Remind me not to buy any sweets from you.........

Not convinced that's true mate.

Use by usually refers to fresh food like fish or poultry which would normally be kept refrigerated until use by the day stipulated, which is usually within a week or so.

Best before is used for longer term products like drinks, sweets and canned products which have a longer period.

I doubt any retailer would get away with selling any product which has passed it's recommended date, regardless of the wording.

I used the "sell by" date as a generalisation.

Andy, my dad used to be a Trading Standards Enforcement Officer. A customer can object to a past BB date saying the goods are not fit but technically its not an offence (eggs are an exception).

However selling after a use by is an offence with a hefty fine.

Jeesh. there's always someone who knows someone, who knows someone who knows everything.  :D :D

Interesting to hear though Paul. Will bear it in mind. Although for the avoidance of doubt, I would never, ever sell anything "past it's date".

Yes, but you can eat the BB ones yourself safe in the knowledge that you 'only' be damaging your waistline.

BTW, I did double check on the FSA website as my dad retired 4 years ago.
